1. Who We Are and Scope

AdsGency AI (“AdsGency,” “we,” “us,” or “our”) provides software and AI-powered tools that help businesses manage, analyze, create, and optimize advertising and marketing activities.

This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information when you visit our websites, create or use an AdsGency account or workspace, interact with us, or connect third-party advertising, marketing, analytics, commerce, or data platforms to the AdsGency Services.

For account administration, billing, website operations, sales, support, security, product analytics, and similar business activities, AdsGency generally determines the purposes and means of processing personal information.

When AdsGency processes data submitted, connected, or made available by a customer through the Services on that customer’s behalf, AdsGency generally processes that data as a service provider or processor in accordance with the customer’s instructions and applicable agreements.

AdsGency AI is operated by:

2. Information We Collect

We may collect the following categories of information:

Account and Workspace Information

Information you provide when creating or managing an account or workspace, such as your name, email address, company name, job title, login information, workspace settings, and related account information.

Billing Information

Information related to purchases, subscriptions, invoices, billing contacts, transaction status, and payment history.

Payment card information may be processed directly by our payment service providers, such as Stripe. AdsGency does not store full payment card numbers where payment information is processed directly by those providers.

Connected Platform Data

If you choose to connect a third-party platform, we may receive information made available through that connection, depending on the permissions you authorize.

This may include advertising accounts, campaigns, creatives, audiences, performance metrics, conversion information, account identifiers, business information, social or marketing content, and other information supported by the connected platform.

Content You Provide

We may process prompts, instructions, advertising copy, images, videos, files, datasets, campaign information, audience information, and other content that you submit to or generate through the Services.

Usage and Technical Information

We may automatically collect information about how you interact with the Services, including IP address, browser type, device information, operating system, pages or features used, timestamps, error logs, diagnostic information, and security-related events.

We may derive an approximate location from information such as an IP address. We do not intentionally collect precise GPS location through the Services unless we specifically disclose that collection at the time it occurs.

‍

3. How We Use Information

We may use personal information to:

  • provide, operate, maintain, and improve the Services;
  • create and manage accounts and workspaces;
  • authenticate users and manage platform connections;
  • generate, analyze, manage, launch, or optimize advertising and marketing activities at a customer’s direction;
  • provide AI-assisted features and generated content;
  • process subscriptions and payments;
  • respond to support requests and communications;
  • monitor performance, reliability, security, fraud, abuse, and misuse;
  • troubleshoot technical issues;
  • analyze product usage and improve product functionality;
  • communicate about the Services, including product, operational, security, and administrative messages;
  • send marketing communications where permitted by applicable law;
  • comply with legal obligations and enforce our agreements; and
  • protect the rights, safety, and security of AdsGency, our customers, users, and others.

We may also use aggregated or de-identified information for analytics, product development, service improvement, research, and other business purposes where permitted by applicable law.

‍

4. Third-Party Platform Connections

The Services may allow you to connect third-party advertising, marketing, analytics, commerce, social media, or data platforms.

These platforms may include, for example, Google, Meta, TikTok, LinkedIn, Pinterest, Reddit, and other platforms that AdsGency supports from time to time.

When you connect a platform, you authorize AdsGency to access and process information available through that connection in order to provide the features you request.

The scope of information we receive depends on the platform, the permissions you grant, your account configuration, and the features you use.

You are responsible for ensuring that you have the necessary rights, permissions, and lawful basis to connect accounts and provide data to the Services.

You may disconnect supported integrations through the Services where that functionality is available, or by revoking AdsGency’s access directly through the applicable third-party platform.

Disconnecting an integration stops future collection through that connection after the disconnection becomes effective. Information previously collected may continue to be retained in accordance with this Privacy Policy, our contractual obligations, applicable law, and our retention practices.

‍

5. Artificial Intelligence Features

AdsGency uses artificial intelligence and machine-learning technologies to provide certain features of the Services.

To provide these features, information you submit may be processed by AdsGency and by third-party service providers that provide AI infrastructure, models, hosting, or related technology.

Where commercially available and appropriate for the Services, AdsGency seeks to use provider configurations and contractual terms that restrict the use of customer content for training general-purpose third-party models.

We do not represent that all third-party AI providers operate under identical retention, processing, or data-handling practices. Their processing may be subject to applicable contractual arrangements and provider-specific terms.

We may use aggregated or de-identified information to evaluate system performance, improve product functionality, test features, enhance reliability, and develop the Services.

‍

6. How We Disclose Information

We may disclose personal information to:

Service Providers

Companies that provide hosting, cloud infrastructure, databases, analytics, AI processing, payment processing, communications, customer support, security, monitoring, and other services on our behalf.

When you direct AdsGency to interact with an advertising or marketing platform, we may transmit information to that platform as necessary to perform the requested action.

For example, if you direct AdsGency to create an advertising audience, launch a campaign, upload a creative, or manage a connected advertising account, relevant data may be transmitted to the platform you selected.

‍

7. Sale and Sharing of Personal Information

AdsGency does not sell personal information for monetary consideration.

AdsGency does not use personal information collected for its own independent business purposes for cross-context behavioral advertising except as disclosed in this Privacy Policy or as otherwise permitted by applicable law.

Customers may use the Services to connect advertising platforms, manage audiences, conduct advertising campaigns, or transmit data to platforms at their direction. In those circumstances, AdsGency processes or transmits information on behalf of the customer in order to provide the Services requested by that customer.

Where applicable law provides rights relating to the sale or sharing of personal information, you may contact us at privacy@adsgency.ai to exercise those rights.

We use Google API data only to provide or improve user-facing functionality associated with the Services and the connection you authorize.

Access to Google API data by personnel is restricted and permitted only where reasonably necessary and permitted by applicable Google requirements, such as:

  • where you request support and authorize access to specific information;
  • for security, abuse prevention, or incident investigation;
  • where information has been appropriately aggregated or de-identified for permitted internal operations; or
  • where required by applicable law.

You may revoke AdsGency’s access to your Google account through applicable AdsGency connection settings where available or through your Google account permissions.

‍

9. Analytics and Cookies

We and our service providers may use cookies, local storage, pixels, SDKs, and similar technologies to operate the Services, remember preferences, maintain sessions, understand product usage, diagnose issues, improve performance, protect against fraud or abuse, and measure the effectiveness of communications or marketing.

We may use third-party analytics providers to help us understand how users interact with the Services.

Where required by applicable law, non-essential cookies or similar technologies will be used subject to applicable consent or preference requirements.

Where cookie preference controls are made available, you may use those controls to manage eligible categories of cookies or similar technologies.

You can also adjust certain cookie settings through your browser or device.

We may request additional information where reasonably necessary to verify your identity, authority, account, or request.

12. California Privacy Information

California residents may have rights under the California Consumer Privacy Act, as amended, including rights relating to access, deletion, correction, limitation of certain uses of sensitive personal information, and opting out of certain sales or sharing of personal information.

AdsGency does not sell personal information for monetary consideration.

If applicable to our processing activities, California residents may submit a request relating to the sale or sharing of personal information by contacting privacy@adsgency.ai.

We will not unlawfully discriminate against you for exercising applicable privacy rights.

When AdsGency processes personal information on behalf of a business customer as a service provider or contractor, requests relating to that information may need to be directed to the relevant customer that determines how the information is used.

‍

13. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain customer accounts, comply with contractual obligations, satisfy legal or regulatory requirements, resolve disputes, prevent fraud or abuse, enforce agreements, and protect our legitimate business interests.

Retention periods vary depending on the type of information, the nature of our relationship with you, applicable customer instructions, technical requirements, legal obligations, and the purposes for which the information is processed.

When information is no longer reasonably required, we may delete, anonymize, aggregate, or otherwise dispose of it in accordance with our applicable processes.

Information stored in backups may remain for a period of time after deletion from active systems until those backups are overwritten or otherwise removed through ordinary backup-management processes.

We maintain administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, use, alteration, loss, disclosure, or destruction.

These safeguards may include measures relating to access control, authentication, encryption, network and infrastructure security, monitoring, logging, incident response, and personnel or vendor controls, as appropriate to the nature of the information and the Services.
